Featured listings and top of category not working

I have an issue with top of category and featured listing not displaying as expected.

On this page it currently shows Example Listing 1 as a fetured listing at the top.

However, this is not set as featured listing in the admin only as top of category. It also appears again at the bottom as a normal listing?

If I switch it and set top no, featured yes it is listed once highlighted in green at the bottom of the list and not as a featured listing!!

if both set to yes i get featured at top and another listing highlighted at the bottom. surely it should only get listed once in the first place.

Any ideas?
