If someone have designed for you a website in 2008. Would you expect them to give you free labor and totally remake website to a new responsive framework for free, just because you have hired them once and your site does not work on new wordpress 3.81?

The v7 theme is fully developed and it will be updated to a new wordpress when such an update is needed.
Therefore you do not have grounds to request a totally new theme (not 80% old as you say). No one takes away from you your theme or your site. You can file a support ticket if you have technical problems.
When was last time you have given something for free to another person?
